Terms of Service and Privacy Policy

Welcome to Spiegelman Art (available at www.spiegelmanart.com), an online platform for the sale of 3D wooden architectural models for self-assembly and educational purposes (hereinafter: the "Website").
The models are manufactured in Israel by Print 3D Ltd. (hereinafter: the "Website Management"), which specializes in 3D modeling, printing of structures, products, and custom solutions. The Website and all related online activities are operated under the brand name Spiegelman Art, offering direct-from-manufacturer access to a wide variety of 3D assembly models.
Please read these Terms of Service and Privacy Policy (the "Agreement") carefully before using or purchasing from the Website. This Agreement constitutes a legally binding contract between you (the "Customer") and the Website Management. By checking the agreement box during registration or purchase, you acknowledge that you have read, understood, and agreed to be bound by these terms. If you do not agree, you may not make purchases through the Website.
1. Eligibility and Website Use
● Age Requirements: You must be at least 18 years old to use this Website independently. Use of the Website by minors under the age of 18 is strictly subject to and conditioned upon the consent of a parent or legal guardian.
● Right to Deny Service: The Website Management reserves the absolute right to refuse service, prevent purchases, or cancel user accounts for any specific customer, for any reason whatsoever, at its sole discretion, even if the customer has successfully ordered products in the past.
2. Order Verification and Rejection
Without limiting the generality of the foregoing, the Website Management may cancel a Customer's eligibility to execute transactions on the Website in any of the following cases:
● If the Customer violated any provisions of this Agreement.
● If the Customer intentionally provided false or incorrect personal details.
● If the Customer performed an act or omission that harms or may harm the Website Management, its online platform, related legal entities, or any third parties (including other customers and suppliers).
● If the Website Management's services were used to perform or facilitate an illegal act under the laws of the State of Israel or the jurisdiction of the Customer.
● If the Customer owes debts to the Website Management or any affiliated companies and has failed to settle them despite the due date having passed.
● If the Customer's credit card or payment method is blocked, restricted, or denied by the credit card company or payment processor for any reason.
3. Product Availability, Inventory, and Accuracy
● Inventory Errors: While we strive to maintain accurate stock levels, inventory errors may occur. If an ordered product is out of stock, the Customer will be provided with an estimated production timeline. The Customer may then choose to wait, exchange the item for an available product, or cancel the order. The Customer shall not be entitled to any compensation or damages resulting from stock shortages.
● Cancellation due to Stock: The Website Management reserves the right to cancel an order entirely if an item is out of stock, provided that any funds collected from the Customer for that item are fully refunded.
● Visual Presentation: All product images on the Website are for illustrative purposes only. Due to differences in digital displays, computer monitors, and photographic lighting, there may be variations between the visual representation on the screen and the actual appearance of the physical product.
● Manufacturer Specifications: Commercial data, product descriptions, and technical specifications are provided based on information delivered by the manufacturer. The Website Management is not liable for minor typos, administrative errors, or discrepancies in descriptions, images, or pricing.
4. International Shipping, Customs, and Delivery
● Domestic Delivery (Within Israel): Local pickup is available free of charge within 2 business days for large orders, subject to prior coordination. Domestic shipping via Israel Post takes approximately 20 business days, and door-to-door courier service takes up to 10 business days, subject to the distribution policies of the domestic courier company.
● International Shipping Disclaimer: Because all models are manufactured in and shipped from Israel, international transit times depend entirely on external international shipping carriers, freight forwarders, and local postal services within the destination country. The Website Management cannot guarantee, predict, or commit to any specific estimated delivery date or arrival window for international shipments.
● Delays & Customs: The Website Management shall not be held liable for any delays in delivery caused by shipping companies, postal strikes, force majeure, or customs clearance procedures.
● Customs Duties, Import Taxes, and Fees: All prices listed on the Website are in Israeli New Shekels (ILS) and include Israeli VAT where applicable by law. Prices do not include international import duties, customs fees, local VAT, or brokerage fees that may be imposed by the destination country. All such additional costs, clearances, and regulatory requirements are the exclusive responsibility of the Customer. If a Customer refuses to release a package from customs due to import fees, resulting in the package being destroyed or returned, the Customer will not be entitled to a refund.
● Delivery Verification: Upon collecting a product or receiving a delivery, the Customer (or anyone on their behalf) must inspect the items. By signing the delivery/pickup confirmation, the Customer affirms that the goods were received in satisfactory condition. No claims regarding visible defects or damages that could have been discovered through reasonable inspection will be accepted post-delivery, excluding hidden factory defects.
5. Intellectual Property and Usage Restrictions
● Exclusive Ownership: All content available on or linked through the Website—including but not limited to product designs, assembly graphics, step-by-step instructions, text, structural logic, blueprints, logos, software, and images—is the exclusive property of the Website Management or its suppliers. It is fully protected under Israeli and international intellectual property, trademark, and copyright laws.
● Prohibition of Reverse Engineering: The Customer is strictly prohibited from copying, reproducing, distributing, publishing, commercially exploiting, or reverse-engineering the physical or digital 3D models, their structural components, or their assembly layouts without explicit, prior written authorization from the Website Management.
● Trademarks: Any unauthorized use of the brand names, trade dress, or trademarks associated with Spiegelman Art that could cause consumer confusion or misrepresentation is strictly prohibited.
6. Pricing, Promotions, and Sales
● Right to Alter Pricing: The Website Management reserves the right to alter prices, run promotions, offer discounts, or discontinue special offers at its sole discretion at any time without prior notice.
● Finality of Promotional Sales: Purchases made during designated special sales, clearance events, or promotional campaigns are final. No returns, refunds, or exchanges will be permitted for items bought under special promotions, except in direct cases of verified manufacturing defects.
7. Cancellation, Returns, and Refunds
Cancellations and returns are governed by the Israeli Consumer Protection Law, 1981 (the "Consumer Protection Law"). Below is a summary of the applicable rules:
● Cancellation Window: In a remote sales transaction, the consumer may cancel the transaction in writing from the day the deal is made until 14 days after receiving the product, or after receiving the disclosure document required by law, whichever is later.
● Cancellation Procedure: To cancel a transaction, the Customer must send a written notice to customer service and obtain written email confirmation of receipt.
● Condition of Returned Goods: Returns will be accepted only if the product is completely unused, has never been opened, and remains in its original, sealed packaging exactly as delivered. If the external packaging or shrink-wrap has been opened, broken, or if the product has been partially assembled, the transaction cannot be canceled, and the product cannot be returned.
● Refunds for Defective Goods: If a cancellation is due to a verified manufacturing defect or non-conformity with the core technical specifications ordered, the Website Management will refund the amount paid within 14 days of receiving the cancellation notice, cancel any future charges, and will not charge any cancellation fees. The product must be returned to an address coordinated with a company representative.
● Refunds for Non-Defective Goods (Change of Mind): If a cancellation occurs due to a change of mind (not due to a defect), the Website Management will refund the amount paid within 14 days, but shall be entitled to charge a cancellation fee of 5% of the product price or 50 ILS (whichever is lower), plus credit card processing fees of up to 0.98% of the transaction value. The Customer must return the product at their own expense and via their own transportation. If the Customer requests the company to collect the item from their home, the Customer must bear the shipping/collection fees.
● Forfeiture of Benefits: Any transaction cancellation automatically voids all benefits, bundle discounts, gifts, or promotional credits received as part of the transaction, which must be returned immediately.
8. Product Liability and Safety
● Age Restriction and Adult Supervision: The 3D assembly models contain small parts and are intended strictly for use by children over the age of 3, and only under direct adult supervision. Do not leave individual structural pieces, components, or packaging materials within reach of unsupervised children due to choking hazards.
● Exclusion of Liability: The Website Management shall not be held liable for any bodily injury, property damage, or consequential loss resulting from a failure to follow the manufacturer's assembly instructions, warning labels, or safety guidelines included within the product packaging.
● Warranty Limitation: The limited warranty for the models covers reasonable, standard use and extends for a period of one (1) month from the date of purchase. Any remedies beyond this timeframe remain at the absolute and exclusive discretion of the Website Management.
9. Privacy Policy and Data Protection
● Secure Processing: The Website implements strict data security protocols. Payment processing complies with the PCI-DSS standard. Credit card details are entered directly on the secure server of the authorized clearinghouse ("Isurit Zahav" by Cardcom) and are never stored or saved on the Website’s servers.
● Data Minimization: Personal data provided by the Customer (such as email, name, and delivery address) is used solely to execute the transaction, process delivery, and fulfill customer support requests. Delivery details (address and phone number) are shared exclusively with the shipping carrier or postal service to facilitate delivery.
● Security Logs: For system security and fraud prevention, the Website automatically collects and analyzes IP addresses.
● Cookies: The Website uses automatic text cookies to optimize user experience, remember sessions, and analyze anonymous traffic data (e.g., page views, age demographics) to improve commercial offerings. Non-identifying statistical data may be shared with advertisers, but no personally identifiable information (PII) will ever be disclosed.
● Marketing Communications: The Website Management will only use your email address to send marketing updates, newsletters, or promotional material if you explicitly opt-in during purchase or registration. You may opt-out at any time by clicking the "Unsubscribe" link in any email or by providing a written request to customer support.
● Legal Disclosures: The Website Management reserves the right to disclose personal data if required to do so by a valid judicial warrant, court order, or applicable law, or within the framework of a legal dispute between the Website Management and the Customer.
10. Limitation of Liability and Force Majeure
● "As-Is" Service: The Website and its services are provided on an "AS IS" and "AS AVAILABLE" basis without any warranties of any kind.
● Force Majeure: The Website Management shall not be held responsible or considered in breach of contract for any delays, failures, or disruptions in performance resulting from events beyond its reasonable control, including but not limited to natural disasters, acts of God, war, acts of terrorism, civil unrest, global pandemics, labor strikes, customs holdups, or severe supply chain disruptions.
11. Governing Law and Jurisdiction
This Agreement, the use of the Website, and any purchase transactions executed through it shall be governed exclusively by the laws of the State of Israel. Any legal disputes arising from or in connection with this Agreement shall be brought exclusively before the competent courts in the district of Rishon LeZion, Israel.
